Concerns remain on youth bill

CORNWALL — Putting teens behind bars more often is not the answer to curbing crime in the community, local youth advocates say.

Amendments to the Youth Criminal Justice Act, part of the Conservatives' major crime bill to be passed in government within the first 100 days, would expand the types of crime youth can be incarcerated for and the amount of time youth might spend in custody.

The youth bill, dubbed Sébastien's Law, is aimed at denunciating and deterring young people from committing crime by using sentencing similar to those given in the adult criminal justice system.

But with national crime rates declining, including crime committed by youth, the government is receiving criticism for targeting youth with tougher sentences.

Cornwall Community Police Chief Dan Parkinson said the practice of using jail to deter youth from committing crime is misguided.

Citing research, Parkinson said using long jail terms as a deterrent has been proven ineffective when dealing with youth.

"How can you ignore evidence-based research?" Parkinson said. "If we don't create (criminals) from birth, we certainly create them by putting them in the formal justice system."

Parkinson said the Youth Criminal Justice Act, which took effect in 2003, contains all the necessary tools to deal with youth who have been charged with committing a crime, but that alternatives are not being applied consistently across the province.

"I see nothing in (the new legislation) that hasn't been at the disposal of the justice system to deal with youth who have been in trouble with the law," Parkinson said.

But Parkinson doesn't believe jail terms for youth should be scrapped all together.

Youth that commit repeat, serious and violent crimes, such as murder, sexual offences and aggravated assault, deserve to do time, he said.

"Jails serve a purpose, but only really if it's applied to the incorrigible ones," he said.

He said the government's shift to fund jail-intensive initiatives is pure politics.

"(The criminal justice system) is a bloated system," Parkinson said. "(It takes) millions each year to keep the formal justice system chugging. In a warped sense, there's good and valid reason to hang on to crime...crime creates jobs for everyone in the criminal justice system."

Parkinson said focus should be at preventing crime in the first place.

"There's huge dollars being thrown at crime, but little being thrown at preventing crime," he said. "You don't need to be a mathematician to see that the economics aren't right.
